This Subscription Services Agreement is entered into between Cyber Growth Hub and the subscribing client. By submitting payment or activating a subscription, you agree to be bound by the following terms.
1. Effective Date & Term
This Agreement becomes effective upon the client's first payment or subscription activation and remains in effect on a month-to-month basis until terminated by either party according to the Cancellation Policy.
2. Billing
Services are billed monthly in advance and renew automatically. The client agrees to maintain a valid payment method on file.
3. Cancellation Policy
A 30-day written notice is required to cancel recurring services. Services remain active during the notice period, and the final billing cycle will remain due.
4. Scope of Services
Growth Care Plan Includes:
- Website hosting
- Platform maintenance
- Technical updates
- Performance monitoring
- Minor website content updates
- Ongoing optimization support
Growth Automation System Includes:
- AI-powered inquiry response automation
- Follow-up messaging workflows
- Appointment reminders
- Lead nurturing automations
- Conversion support systems
5. Additional Work
Major redesigns, new page builds, advanced integrations, custom development, or large content requests are not included unless otherwise agreed upon in writing.
6. Client Responsibilities
Clients are responsible for providing accurate business information, reviewing submitted content, maintaining access to required third-party accounts, and responding to approval requests in a timely manner.
7. Third-Party Platforms
Cyber Growth Hub may utilize third-party platforms and software providers including hosting providers, AI tools, and communication services. Availability may depend on those services remaining operational.
8. Intellectual Property
All systems, workflows, AI prompts, and proprietary strategies developed by Cyber Growth Hub remain the intellectual property of Cyber Growth Hub. The client retains ownership of their own brand assets, customer data, and original content.
9. No Guaranteed Results
While Cyber Growth Hub works to improve customer engagement, conversions, and operational efficiency, specific revenue, lead volume, or search ranking outcomes cannot be guaranteed.
10. Suspension for Non-Payment
Services may be paused or suspended for overdue invoices or failed subscription payments. Cyber Growth Hub reserves the right to withhold deliverables or system access until the account is brought current.
11. Confidentiality
Both parties agree to maintain the confidentiality of any proprietary information, business strategies, or customer data shared during the course of this engagement.
12. Limitation of Liability
Cyber Growth Hub shall not be held liable for any indirect, incidental, or consequential damages, including loss of revenue or data, arising from the use of our services or third-party platform outages.
13. Dispute Resolution
Any disputes arising from this Agreement shall be resolved through good-faith negotiations. If a resolution cannot be reached, the parties agree to binding arbitration.
14. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles.
15. Agreement Acceptance
By submitting payment, activating a subscription, or continuing to use the services, the client acknowledges that they have read, understood, and agree to be bound by this Subscription Services Agreement.
